Terms & Conditions: VARIABLES 1.1 The Competition is open to residents of New Zealand only over the age of 18 years old. 1.2 Commencement time: 09:00am AEST (11:00am NZST) 1.3 Commencement date: Wednesday 17th April 2024 1.4 Closing time: 10:00am AEST (12:00pm NZST) 1.5 Closing date: Wednesday 8th May 2024 1.6 Draw time: 10am AEST (12:00pm NZST) 1.7 Draw date: Friday 10th May 2024 1.8 Draw location: 19 O'Riordan St, Alexandria NSW 2015 WHO MAY ENTER The only persons who may enter into the competition and be awarded prizes are those people specified in Condition 1.1 and who are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition; or (ii) members of the immediate family of such employees and contractors, including any spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee or /contractor. Persons must reside within New Zealand. HOW TO ENTER To enter the promotion, entrant needs to enter the required details into the registration form at https://cloud.e.au.teva.com/nz-rafting-competition or via the meta form ads or website pop up for an account with Teva New Zealand, then accept the terms and conditions of entry and submit entry into the draw. By entering the competition, entrants consent to receive marketing communications from the Promoter and RealNZ. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction. LIMITATIONS ON ENTRY One entry allowed per person (identified by email). Multiple entries per household are allowed. Persons wishing to enter must comply with condition 1.1. DURATION The competition commences at the time specified in Condition 1.2 on the date specified in Condition 1.3. Entries must be received by the time specified in Condition 1.4 on the date specified in Condition 1.5. SELECTION OF WINNER The will be one (1) winner drawn from the total entrant database at the time specified in condition 1.6 on the date specified in condition 1.7, and will be conducted at the location specified in condition 1.8. The first valid entry as per condition 1.1 drawn will win the prize. The competition is a game of chance. The Promoter reserves the right to verify the validity of entries at any time during or after the promotional period, and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. To the extent permitted by law, the Promoter is not responsible or liable for: (a.) inaccurate / incorrect transcription of entry information; (b.) purported entries that are not received for any reason, including because they were incorrectly uploaded or misdirected, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions; (c.) unauthorised human intervention in any part of the competition; (d.) electronic or human error which may occur in the administration of the competition; (e.) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or (f.) any technical difficulties or equipment malfunction (whether or not under either Promoter’s control); (g.) any theft, unauthorised access or third party interference. Promoter’s decision is final and no correspondence will be entered into. WINNER NOTIFICATION, PUBLICATION AND REDRAW The winners will be notified via email within 48 hours after the draw. The winners will be contacted via the email address which was entered into the competition. Despite the Promoter’s best efforts to contact the prize winner or deliver a prize, if a prize remains unclaimed by 29 May 2024 then, subject to any written directions given by a relevant lotteries or gaming authority the Promoter may conduct an unclaimed prize draw at the same time and place as the original prize draw on that date to distribute the unclaimed prize. The first valid entry drawn will win the unclaimed prize. The winner of the unclaimed prize draw will be notified by email 48 hours after the draw. The winners name will be published on our website at https://nz.teva.com PRIZE Total prize pool value is up to the maximum value of $2,398 NZD. There will be one (1) major prize valued at $2,398. The prize includes: RealNZ - Shotover River Rafting for two: $598 Travel Voucher - valued at $1500 2 x Pairs of Teva Original Universal sandals - valued at $240 2 x Teva towels ($40) and 2 x Teva Tote bags ($20)   Terms and condition of the prize: Participation in rafting activities involves a degree of risk and RealNZ cannot absolutely guarantee participants' safety. Participants must be able to swim confidently as there is a good chance they will fall out of the raft. They must follow directions from our guides to swim to safety. RealNZ reserves the right to cancel trips or substitute another river or section of river for safety reasons. Please ensure you have read and accepted our terms and conditions prior to entering the competition. RealNZ rafting trips operate with minimum numbers of people. Customers need to reconfirm at least 24 hours before departure to ensure their trip will be operating. All trips operate depending on weather, river level and/or water temperature. Portages may be required based on changes to the water level and flow. RealNZ reserves the right to amend timetables, cancel departures, substitute plant and equipment, amend specials or offers and alter ticket prices at any time. All agreements and contracts shall be subject solely to New Zealand law and the exclusive jurisdiction of the New Zealand courts. The prize is non-transferable and non-redeemable for cash. Any attempt to resell or auction all or any part of this prize will result in an immediate cancellation of the prize. In the event that, for any reason whatsoever, a winner does not take an element of the prize at the time stipulated by the promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. The promoter shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect or consequential loss) or for personal injury which is suffered or sustained, in connection with the prize, except for any liability which cannot be excluded by laws. The promoter reserves the right to withdraw or amend the competition as necessary due to circumstances outside its control The promoter reserves the right to substitute any component of the prize for an itinerary of equal value at their discretion Prize winners will be required to agree to the terms of Teva prize offering, otherwise prize will be forfeited On entry into the competition, the Participant acknowledges that they have read and agreed to Teva conditions. The prize awarded may not be exactly as illustrated in displays or marketing for the Competition. Participants will have the option to unsubscribe to communications should they choose at any point. DISCLAIMER AND INDEMNITY The competition entrant and any participants in the prize are aware that by participating in any activities the subject of the prize, there are certain risks or dangers of serious physical or mental injury or harm or even death. To the extent permitted at law, the Promoter and its related entities, officers, employees, contractors and agents disclaim any liability of any kind (including in contract, tort and breach of statutory duty) for loss, personal injury, death, property damage or otherwise that you may suffer yourself or cause to other persons or property as a result of any activities related to the prize that you undertake or commence, whether inspired by the Promoter or its related entities, officers, employees, contractors and agents, or otherwise. The prize winner and his/her guests acknowledge their personal responsibility and knowingly and willingly assume the risks of associated with any activities related to the prize. The Promoter does not condone or encourage in any way the consumption of alcohol or use of illicit narcotics. The prize winner and his/her guests agree to indemnify, defend and hold harmless the Promoter and its related entities and officers for any and all claims, demands, suits, loss, damage, injury, and liability, including costs, expenses, and reasonable solicitors fees arising from, or in any way connected with, the prize. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours, the Promoter reserves the right to substitute a different prize item of equal or greater value.
